User Acceptance of Terms of Use

Thank you for visiting the official website, visitlauderdale.com (the "Site"), of the Greater Fort Lauderdale Convention & Visitors Bureau (GFLCVB), a department of Broward County, Florida. It is presented to you (as the user) by Broward County. Our Site adheres to preferred internet standards by complying with the State of Florida's Public Records statutes and laws, observing and championing internet etiquette, linking externally without endorsements, and striving for accurate factual information throughout the Site. By accessing or using the Site or any information, materials and data contained in the pages within the Site, the user hereby agrees to and accepts the current terms and conditions ("Terms of Use") for use of this Site. Broward County reserves the right to amend and update these Terms of Use from time to time. 

By visiting the GFLCVB Site, users agree that they will not use the Site for any unlawful activity or use it in any way that would violate any of the terms and conditions stated in these Terms of Use. Users agree to comply with all applicable laws, rule and regulations in connection with the use of this Site, including, without limitation, all applicable intellectual property law, privacy laws, and the Florida Ban on Texting While Driving Law, Florida Statutes Section 316.305. If at any time you choose not to accept the Terms of Use stated herein, you should not access or use the Site.

Accessibility

The GFLCVB is committed to providing access to all individuals seeking information on the Site. As part of that effort, the GFLCVB has adopted certain standards for the Site developed from the following best practices:

  • Web content accessibility guidelines as provided by the World Wide Web Consortium (W3C).

End-User License Agreement (APPS)

This End-User License Agreement ("Agreement") governs the terms and conditions for use by you or any end user (“You”) of this mobile application (“App”) provided by the GFLCVB. By clicking the "I Agree" button or downloading or using the App, you are agreeing to be bound by the terms and conditions of this Agreement. The GFLCVB may modify this Agreement at any time; your continued use of the App shall constitute your agreement to the modified terms of this Agreement.

  • The GFLCVB grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the App solely for your personal, non-commercial purposes and to be used solely in accordance with the terms of this Agreement. All rights, title, and intellectual property interests in the App remain exclusively with the GFLCVB.
     
  • You agree not to use the App for any purpose that is unlawful or prohibited by this Agreement. Prohibited uses include, without limitation, the abuse or harassment of any person, transmitting defamatory, offensive, or other inappropriate materials, creating or transmitting spam, or the infringement or violation of the intellectual property rights of any entity. You agree not to use the App to transmit any sensitive data, including, without limitation, protected health information or personal financial information.
     
  • By transmitting any information, images, or recordings (audio or visual) through the App, you grant to the GFLCVB and its agents and contractors an irrevocable, non-exclusive, worldwide, unlimited right to use, store, copy, reproduce, create derivative works, publicly display the work, perform the work, and sublicense all or any portion of these rights, in any manner and to the extent the GFLCVB elects in its sole discretion. You warrant and represent that you have sufficient right and title in the material submitted to grant these rights to the GFLCVB, and you agree to indemnify the GFLCVB for any damage resulting from a breach of any representation or warranty of this paragraph. The rights granted pursuant to this paragraph shall survive the termination of this Agreement.
     
  • You agree to allow the GFLCVB to collect, store, and utilize your account information, personal information, information regarding your device, and data regarding your use of the App. This information may include time, location, GIS information, or other metadata, particularly if you submit images, videos, or recordings using the App or allow the App permission to utilize your location information or to access your device’s images, audio, or contacts. The GFLCVB will utilize this information solely for governmental purposes, and will not sell your data to any third party but may share the information with third parties. The GFLCVB is subject to the public records laws of the State of Florida, and any information that you transmit using the App may be a public record and subject to disclosure in accordance with Chapter 119 of the Florida Statutes.
     
  • You agree not to, and you will not permit others to, license, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose, or otherwise commercially exploit the App. You agree not to modify, reverse-engineer, decompile, attempt to derive the source code of, create derivative works, decrypt, or otherwise modify the App.
     
  • The App is provided to you on an “as is” basis. As such, to the fullest extent permitted by law, the GFLCVB makes no warranties whatsoever, whether expressed or implied, including any warranties regarding merchantability or fitness for a particular purpose. The GFLCVB does not warrant that the App or your use of the App will be uninterrupted or error-free, or that any data or materials transmitted using the App will be secure or protected. The GFLCVB is not responsible for any damage to your device or loss of data, including without limitation related to any data breach, security breach, or operating system vulnerability. You agree to hold the GFLCVB, its agents, and contractors harmless in the event of any loss, injury, or damages that occur to you or otherwise arise in connection with your use of the App.
     
  • The GFLCVB may periodically update or modify the App, including to improve performance and functionality, but the GFLCVB does not guarantee or provide any support and maintenance of the App or your use of the App. The GFLCVB reserves the right to modify, suspend, or discontinue, temporarily or permanently, the App or any service to which it connects, with or without notice and without liability to you.
     
  • The GFLCVB may terminate this Agreement at any and for any reason whatsoever, by discontinuing the App, with or without prior notice to you. You may terminate this Agreement by deleting the App from your devices. Upon termination of this Agreement, you shall cease all use of the App and delete all copies of the App from your devices.
     
  • If any provision of this Agreement is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
     
  • This Agreement shall be governed by the laws of the State of Florida, and any action arising out of or in connection with this Agreement or the App shall be subject to the exclusive jurisdiction of the state courts of the Seventeenth Judicial Circuit Court in and for Broward County, Florida. You agree to submit yourself to the personal jurisdiction of the state courts of the Seventeenth Judicial Circuit Court in and for Broward County, Florida, in connection with any such legal action.

How We Use Cookies

In order to process some transactions (or in the future to customize content specific to your geographic area or interests), we use cookie technology. A cookie is data that is stored on your computer's hard drive or is stored temporarily by our system. This data allows the user's browser to communicate with the Site's servers. We use the cookie to track your progress during a transaction such as paying your real estate taxes online. The cookie is saved to your computer and keeps track of the pages you visited on the Site. This tracking allows you to move quickly and easily across the Site without having to be reprocessed each time you move to a new page or area of the Site.

Indemnity

As a condition of use of the Site, the user and anyone linking to the Site agrees to indemnify the GFLCVB, its Broward County Commissioners, officers, employees, and agents against any and all liability, expenses (including attorney's fees and court costs) and damages arising out of claims resulting from the user's use of this Site or anyone linking to the Site, including, without limitation, any claims alleging facts that if true would constitute a breach of the terms and conditions stated in this Terms of Use. The GFLCVB does not waive any rights or remedies by virtue of providing the Site.​

Intellectual Property Rights

The GFLCVB owns all rights, title and interest in the trademarks, logos, and other protected intellectual property of the GFLCVB. You may not use the GFLCVB trademarks, logos, or other protected intellectual property without the GFLCVB's prior written permission. You acknowledge and agree that nothing on the Site grants, expressly or implicitly, by estoppel or otherwise, any right or license to use any of the GFLCVB intellectual property rights or may be construed to mean that the GFLCVB has authority to grant any right or license on behalf of any third-party trademark owner. You may not reproduce, distribute, display, transmit, modify, perform, adapt, generate derivative works of, or otherwise use the content of the Site without the prior written permission of the GFLCVB unless your use qualifies as "Fair Use" under applicable law. Fair Use includes the reproduction, distribution, display, transmission, performance, and use of the content if done in accordance with 17 U.S.C. §107, 17 U.S.C. §110, or other applicable limitations and exemptions set forth in the U.S. Copyright Act and related laws.

Unless otherwise noted on a particular page or section of the Site, no express permission is required from the GFLCVB for use that falls within Fair Use, provided that (1) no modifications may be made as to the integrity or attribution of the content of the Site, and Content and Compilation, and (2) all copies of the content of the Site must bear accurate identifying information, including proprietary collection information, credit lines, copyright and trademark notices, and a citation to the Site. ​

Intrusion Detection

For security purposes and to help ensure this service remains available to you, we use special software programs for monitoring network traffic to identify unauthorized attempts to upload or change information, or otherwise to cause damage to a government computer system or this Site. These programs collect no information that directly identifies individuals, but they do collect information that could help us identify someone attempting to tamper with this Site.

The user understands and agrees that all activities on this Site may be monitored and recorded. Anyone using this Site expressly consents to such monitoring and recording. WARNING: If such monitoring reveals possible evidence or information of criminal/unlawful suspicious activity, monitoring records may be provided to law enforcement officials without any prior oral or written notice to you.​

Jurisdiction

These Terms of Use are governed by the laws of the State of Florida, United States of America (USA). User and/or anyone linking to this Site consents to exclusive jurisdiction and venue of the courts in Broward County, Florida, USA for any dispute arising out of or relating to use of this Site. The users of the Site or anyone linking to this Site in jurisdictions outside of Broward County, Florida, (including outside the USA boarders) consent and submit to personal jurisdiction in Broward County, Florida.​

Linkage

The Site may provide links to websites that are not controlled, maintained, or regulated by the GFLCVB. In addition, users interacting through any of the Site's communication forums may post links to various websites. The GFLCVB is not responsible for the accuracy of the links or the content of those linked websites. Use of information from those websites by the user is voluntary and at the user’s sole risk. The GFLCVB reserves the right to delete any link posted by a user. Users should rely on information from non-GFLCVB agency sites only after undertaking an independent review of its accuracy. References in those websites to any specific commercial product, process, or service by trade name, trademark, or otherwise, does not constitute or imply endorsement, recommendation, or favoring by the Site. When linking to a non-GFLCVB agency site, you are subject to the privacy policy and other terms of use of the new site and the information collected or used on those non-GFLCVB agency sites.

The determination of whether to establish a link to a private organization/commercial's website or non-profit organization website is made by the GFLCVB on a case-by-case basis in the sole discretion of its Site Administrator. The GFLCVB declines to link to any website that contains any nudity or profane or obscene language as determined in the sole discretion of its Site Administrator.

The GFLCVB encourages and permits links to content on the Site. Under no circumstances should the linking (a) suggest that the GFLCVB promotes or endorses any third party's causes, ideas, websites, products or services; (b) use the GFLCVB’s Site content for inappropriate and/or commercial purposes; (c) contain any hyperlink to any other sites without the prior written consent of such sites(s); or (d) violate any patent, copyright, trademarks, trade names, intellectual, or other property rights of any third-party. In addition, links to the Site shall be executed so that the linked page does not appear within a frame that prevents book marking the linked page or prevents the acknowledgment of the GFLCVB as the owner of the content. the GFLCVB reserves the right to withdraw permission for any link at any time with or without prior written notice or oral notice.

Privacy Policy

It is the policy of the State of Florida that all records of the state or political subdivisions of the state are open for public inspection and copying, subject to certain exemptions. This policy is embodied in the Florida Constitution, together with the right of an individual to be free from unauthorized governmental intrusion into their private life, as provided in Article 1, Section 23 of the Florida Constitution. Use of the Site acknowledges that any personal information provided is subject to Florida's Public Records Policy as stated in Chapter 119, Florida Statutes, and Article I, Section 24 of the Florida Constitution, subject to any applicable exemptions.

You do not have to give us personal information to visit the public portions of the Site, download our publications, use our email communications, or access any other public feature of the Site. Under Florida law, email addresses are public records. If you do not want your email address released in response to a public-records request, do not send electronic mail to this entity. Instead, contact the GFLCVB agency by phone or in writing. Written correspondences to such agency are also public records unless there are exemptions under the law.

The GFLCVB may use any information, comments, or other material on the Site in connection with the operations, policies and practices of the GFLCVB. The GFLCVB may or may not identify or reference any user in connection with any posting, comment, or other material submitted on the Site, as the GFLCVB deems appropriate in its sole discretion. Any information, proposals, concepts, ideas, or other submissions on the Site shall constitute publicly-disclosed information and may be used by the GFLCVB for any purpose and in any context whatsoever without attribution, payment, or other obligation to the user. If and to the extent any protected material is submitted by any user on the Site, such submission shall constitute an unlimited, perpetual, license and grant to the GFLCVB for any and all use of the material by the GFLCVB for any purpose and in any context whatsoever without attribution, payment, or other obligation to the user.

Site Security

When you use a credit card, debit card, or an online check to do business on the Site, we protect the integrity and privacy of your account information with advanced technology. The GFLCVB's systems use Internet data encryption technology, known as the Secure Sockets Layer (SSL) protocol, Secure Hypertext Transfer Protocol (SHTTP), and Secure Electronic Transactions (SET).

The GFLCVB makes no representation and assumes no responsibility or liability concerning the accuracy of the information or for any loss which might result to the user through the use of this Site. Please be aware that in the event unauthorized access, unauthorized disclosure, third party intervention, or any loss occurs due to error, omission, or inaccurate information being displayed on this Site, the GFLCVB reserves the right to recover any such damages including any applicable fees, taxes or other funds owed the GFLCVB.

Access to the Site is at the risk of the user. The user must take any and all appropriate steps to maintain the security of the data you are transmitting or receiving from the Site, as well as any information stored on your local computer.

Social Media

Subject to Terms of Social Media Service Provider and the GFLCVB

Twitter, Facebook, Instagram, Pinterest and YouTube are free services, and as such are susceptible to the interruptions and outages inherent in using any Internet based program. The GFLCVB’s participation in these services is offered as a public convenience to share information about the GFLCVB programs, services, events and activities. The GFLCVB cannot guarantee these services will be available or functional at all times. When participants register for these services they are subject to the terms of use as provided by the service providers as well as the GFLCVB terms of use stated herein.

Subject to Text Messaging Rates

Participants are encouraged to research details of their cell phone contract with regard to the cost of text messaging. Standard text messaging rates may apply if you choose to receive tweets through text messaging on your cell phone. Broward County is not responsible for any such charges.

Subject to Florida Public Records Laws

Most of the GFLCVB’s communications on Twitter, Facebook, Instagram, Pinterest and YouTube are one-way posts and for informational purposes only. All information posted to a social media site by the GFLCVB is considered a public record under the State of Florida’s Public Records Law and as such will be archived for the required retention period and available to any person upon request.

Subject to Florida’s Sunshine Law, County Ordinances and Procurement Code

The GFLCVB’s communications on Twitter, Facebook, Pinterest and YouTube that allow public posts are subject to the Florida Sunshine Laws, Broward County’s Procurement Code and the Broward County Code of Ordinances. Therefore, the following public posts are prohibited:

  1. Two-way interactive discussions between members of any Broward County task force(s), committee(s), subcommittee(s), advisory board(s) and board(s) on matters which will foreseeably come before the members for official action. These discussions are required to be held in a meeting that has been properly advertised and noticed to the public.

  2. Two-way interactive discussions that could be perceived as negotiation between vendors and Broward County staff who are engaged in the negotiations process for a pending solicitation matter. Broward County’s Procurement Code requires these negotiations to be held in a meeting that has been properly advertised and noticed to the public.

  3. Two-way interactive discussions relating to matters which are prohibited by the “cone of silence” which is triggered during a procurement process to ensure fairness to all vendors competing for Broward County’s business. The cone of silence is mandated by the Broward County Code of Ordinances.

  4. Any other communications prohibited by local, County, State or federal laws or regulations.

What We Collect and Store Automatically

The Site automatically collects the following information:

  • Name of the domain from which you access the Internet (for example, xcompany.com, if you use a private Internet access account, or yourschool.edu if you connect from an educational institution's domain);
  • The page from which you came and the pages that you access.
  • Date and time you access our Site;
  • Internet address of the website from which you linked directly to our Site;
  • The system's IP (Internet Protocol) address you use to access the Site; and
  • The type of browser and operating system you used to access our Site.

This information may be used in the aggregate to count the number and types of visitors to the different pages on our Site and to help us make our Site more useful to visitors like you.

Opt-in/Opt-out

If you would prefer that GFLCVB not e-mail you any periodic updates about Greater Fort Lauderdale and/or not share any personally identifiable information about you with any third party, all you need to do is tell us. Photo / Video Terms & Conditions

By submitting your photo and using #VisitLauderdale, #YesVisitLauderdale or tagging @VisitLauderdale you hereby grant the Greater Fort Lauderdale Convention & Visitors Bureau (GFLCVB) the right to reproduce and use the supplied images for any digital or print advertising, social media, trade or editorial purposes without restriction. 

The purpose is to use photograph(s) and/or video(s) to promote visitation to the Greater Fort Lauderdale area. By accepting these terms and conditions, you are hereby affirming that you are the copyright holder of the photograph(s) and that your release of the photograph(s) is voluntary, and that you acknowledge you will receive no financial compensation from the Greater Fort Lauderdale Convention & Visitors Bureau (hereby referred to as “VisitLauderdale”), its contractors or its employees for use of the photograph(s) to promote Greater Fort Lauderdale and its attractions.

You further agree that inclusion of your photograph(s) or video(s) in any, but not limited to, publications, websites, videos, advertisements, or social media produced by the GFLCVB confers upon you no rights of ownership whatsoever. You agree to indemnify and hold the GFLCVB, their respective successors, licensees and assigns harmless against any liabilities and expenses (including reasonable attorneys’ fees) you may incur as a result of claims and/or proceedings relating to the use of the content in any materials produced pursuant to this license.  The GFLCVB will not sell released photos to third parties. Please include necessary photo credits.

By accepting these terms and conditions, you are assigning the GFLCVB the right to royalty-free, non-exclusive, perpetual use of photos in any future, including but not limited to, publication, advertisement or promotion, whether in print, video, or digital format as the GFLCVB sees fit. The GFLCVB will not violate or infringe upon the copyright or any other rights of any third party. You acknowledge and understands that GFLCVB may alter, crop, edit or otherwise modify the content as reasonably necessary for its intended usage.

The GFLCVB may request a high-resolution, or original, version of the requested photograph. In providing the photograph(s), you agree to these same terms and conditions.
